Learning outcomes:
This two-part lecture course aims to shed light on the important international legal frameworks and regulatory structures in the fields of industrial property rights (trademarks, patents, utility models, designs) and competition (unfair competition and cartels) that govern contractual agreements used in cross-border business. The course also focuses on special aspects of law relevant to the tourism industry, such as travel law. Students will learn to appreciate and deal with the increasing internationalization and Europeanization of law. The most important international statutory provisions will be discussed. Students will be introduced to important types of contract, will learn about negotiating and formulating international contracts, and will become acquainted with the rules and restrictions that apply to cross-border competitive trade in the tourism industry.

- Inhomogeneity, sources of law, legal nature and components of international private law - The fundamental difference between substantive law and conflicts of law - The UN Convention on Contracts for the International Sale of Goods (CISG) - Germany’s international private law, especially the lex contractus - Legal enforcement of claims, dispute avoidance and dispute resolution - Negotiating an international contract - Selected contracts used in foreign trade - Contracts governing international cooperation and foreign subsidiaries - Areas of law relevant to tourism (travel law etc.)
